These Terms of Service and End User License Agreement, also called our Terms of Use (together, “Terms”), govern your use of Neon Arcana, firstsignalgames.com, neonarcana.game, and related game services operated by First Signal Games LLC (“First Signal Games,” “we,” “us,” or “our”). By installing, accessing, or playing Neon Arcana, you agree to these Terms.

If you download Neon Arcana through Apple, Google, TestFlight, Google Play testing, or another app marketplace, that platform’s rules and payment terms also apply. If a platform term conflicts with these Terms, the platform term controls to the extent required by that platform or applicable law.

Eligibility

Neon Arcana is not directed to children under 13. You must be at least 13 years old, and older if your local law requires, to create or use a game account. Before you sign in, the app asks you to confirm that you are at least 13 and to accept these Terms. If you are under the age of majority where you live, by accepting these Terms you also confirm that your parent or legal guardian has reviewed and agreed to them. If we learn that a child under 13 has created an account or provided personal information, we will take steps to delete that information and block access.

Game account and sign-in

Neon Arcana does not support guest play. Sign in inside the app with Apple, Google, First Signal Email, or a username and password. You are responsible for activity on your account and for keeping your device and sign-in credentials secure. Callsigns, profile names, and other account identifiers must follow these Terms and our community standards. You may delete your account as described on our account deletion page.

Limited game license

Neon Arcana and all related software, artwork, characters, music, text, code, systems, websites, and game content are owned by First Signal Games or our licensors. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and play Neon Arcana for your own non-commercial entertainment, subject to these Terms. We do not sell you the game, game content, virtual currency, items, accounts, ranks, or entitlements.

Virtual currency, items, and entitlements

Virtual currency, cosmetics, bundles, passes, ranks, progression, and other in-game items are licensed digital entitlements. They have no cash value, are not bank deposits or stored-value instruments, are not redeemable for money or prizes, and may not be sold, transferred, exchanged, or traded outside Neon Arcana. We may balance, modify, replace, suspend, or discontinue game content and entitlements as part of operating the game, except where applicable law requires otherwise.

Purchases

Neon Arcana is free to download and play. It offers three kinds of optional real-money purchases, each described below: the Neon Arcana Premier subscription (auto-renewing), the Season 1 Pass (a one-time purchase), and Neon Crystal packs (virtual currency).

Real-money purchases are currently available only through Apple’s App Store, inside the Neon Arcana app on Apple devices such as iPhone and iPad, and Apple charges them to your Apple Account. Purchases through Google Play, including in any Android version of Neon Arcana, are not currently available. If purchases become available through Google Play, Google will process them under Google Play’s terms. Apple’s payment terms and policies govern payment authorization, taxes, Family Sharing, and chargebacks for App Store purchases.

The price shown at checkout, in your App Store’s local currency, is the price that applies. US dollar amounts in these Terms and on our websites are United States reference prices only. Purchases never change Grid combat, and cosmetic items change only how things look.

First Signal Games websites are not a web store for digital Neon Arcana value. We may separately sell physical trademarked merchandise such as shirts, playing cards, posters, art books, stickers, or convention goods, but Neon Crystals, Signal, passes, bundles, cosmetics, boosts, account perks, and in-game entitlements are never sold on our websites. Where they are offered for real money, they are purchased only inside the app, through the App Store as described above.

Neon Arcana Premier (auto-renewing subscription)

Neon Arcana Premier is an auto-renewing subscription. It comes in two options that belong to the same subscription, so an Apple Account can have only one of them active at a time:

• Neon Arcana Premier Monthly: US$4.99 per month, renewing every month.
• Neon Arcana Premier Annual: US$39.99 per year, renewing every year.

While your Premier membership is active, it includes:

• Season Pass earning: you earn on the premium reward track of the current season’s Season Pass. This continues into later seasons for as long as your membership stays active.
• 700 Neon Crystals for each paid month. On Premier Annual, they arrive monthly during the paid year.
• Kip, a permanent companion, added to your account once after payment is confirmed.

Premier Annual also includes Solace, a second permanent companion, and a bonus of 600 Neon Crystals at the start of each paid year, in addition to the monthly Neon Crystals.

Premier benefits for a paid period are delivered only after Apple confirms payment for that period. If you cancel, your membership stays active until the end of the time you have already paid for. When your membership ends, Season Pass earning, Neon Crystal deliveries, and other continuing Premier benefits stop. Pass rewards you have already claimed, Neon Crystals already delivered, and companions you have received stay on your account, except as described under “Refunds and reversed purchases” below.

Payment, renewal, and cancellation on the App Store

• Payment is charged to your Apple Account when you confirm the purchase.
• Your subscription renews automatically for the same period (a month or a year) unless you cancel it at least 24 hours before the end of the current period.
• Your Apple Account is charged for the renewal within the 24 hours before the end of the current period, at your plan’s price at that time. Apple notifies subscribers of price increases under its policies.
• You can manage or cancel your subscription in your Apple Account settings. On iPhone or iPad, open Settings, tap your name, then tap Subscriptions. Cancelling stops future renewals; it does not end or refund the current period.
• If a free trial or introductory price is offered for Premier, its terms are shown at checkout before you confirm, and any unused part of a free trial ends when you buy a subscription.
• Whether a change between Premier Monthly and Premier Annual takes effect immediately or at your next renewal is decided by Apple and shown when you make the change.
• Deleting your First Signal account, or deleting the app, does not cancel an Apple subscription. Cancel it in your Apple Account settings.

Season 1 Pass (one-time purchase)

The Season 1 Pass is a one-time purchase of US$14.99. It is not a subscription and does not renew. It unlocks the premium reward track of the Season Pass on your account for Season 1, which runs for a limited time, and it does not include later seasons. Pass rewards you claim stay on your account after Season 1 ends, except as described under “Refunds and reversed purchases” below. Premier also includes Season Pass earning while your membership is active; if you have both, Pass rewards are not given twice.

Neon Crystals (virtual currency)

Neon Crystals are Neon Arcana’s premium virtual currency. They are not earned through gameplay. You get them by buying a Neon Crystal pack in the app, or as a benefit of an active Premier membership as described above. Neon Crystal packs are one-time consumable purchases; the packs currently offered contain 500, 1,200, 3,250, 7,000, or 15,000 Neon Crystals, and each pack’s contents and price are shown before you buy. You can spend Neon Crystals in the game on items such as skins, boards, and pets, at the prices shown in the app.

Neon Crystals are a limited license to use a feature of the game, not money or property. They have no cash value, cannot be transferred to another account or person, and cannot be redeemed for money or anything of monetary value, except where applicable law requires otherwise. Neon Crystals are removed if your account is deleted and cannot be restored to a new account.

Refunds and reversed purchases

Refunds for App Store purchases are decided by Apple under its policies; we cannot issue refunds for App Store purchases ourselves. You can request a refund from Apple at reportaproblem.apple.com.

If a purchase is refunded, reversed, or charged back, including a refund granted by Apple or Google, we may remove the purchased item or virtual currency and any rewards, companions, or other benefits that purchase granted, and we may adjust your virtual-currency balances to reverse what that purchase added. This applies even to items these Terms otherwise say stay owned after a membership lapses or is cancelled. If the platform later reverses the refund, we may restore what was removed.

Purchases belong to your First Signal account, not to your device. If a purchase seems to be missing, or you move to a new device, sign in to the same account and use Restore Purchases in the app before buying again.

User content and communications

Neon Arcana may let you submit or transmit content such as callsigns, chat messages, voice-chat communications, party or friend interactions, support messages, feedback, bug reports, and moderation reports (“User Content”). You keep whatever rights you have in your User Content, but you grant First Signal Games a worldwide, non-exclusive, royalty-free license to host, store, display, transmit, reproduce, adapt, moderate, and use that User Content as needed to operate, improve, secure, and support Neon Arcana.

Do not share sensitive personal information in chat, voice, callsigns, or public-facing game areas. Voice features, if enabled, are intended for live player communication; we do not permit users to use voice or chat to harass, threaten, groom, exploit, or endanger anyone.

Community standards

You agree not to:

• Harass, threaten, bully, stalk, dox, exploit, or impersonate another person.
• Use hate speech, sexual content, violent threats, self-harm encouragement, or content that exploits or endangers children.
• Upload, transmit, or request unlawful, infringing, or privacy-invasive material through callsigns, chat, voice, reports, or support channels.
• Cheat, exploit bugs, reverse engineer restricted service code, use unauthorized automation, manipulate matchmaking, or interfere with game systems.
• Sell, trade, transfer, or redeem accounts, virtual currency, items, ranks, or digital entitlements outside the app or game.
• Use Neon Arcana for commercial promotion, spam, scams, phishing, malware, or any unlawful purpose.

Moderation and safety enforcement

We may filter, review, hide, remove, preserve, or disclose User Content and account data where reasonably necessary to operate the service, enforce these Terms, investigate abuse, protect players, comply with law, or respond to lawful requests. We may warn, mute, block, suspend, terminate, reset, or restrict accounts or entitlements for violations or suspected abuse. We are not required to refund purchases or restore progress when an account is restricted for violating these Terms, except where applicable law or platform policy requires otherwise.

We have zero tolerance for child sexual exploitation or abuse. We may report apparent child sexual abuse material, grooming, online enticement, or related child-safety threats to the National Center for Missing & Exploited Children, law enforcement, platforms, or other appropriate authorities as required or permitted by law.

Updates, availability, and beta features

Neon Arcana is an online game that may change over time. We may patch, rebalance, add, remove, suspend, or discontinue features, modes, content, items, offers, or services. Beta, TestFlight, closed-testing, preview, or experimental features may be incomplete, reset, unavailable, or changed without notice.

Feedback

If you send us ideas, suggestions, bug reports, balance feedback, or other feedback, you allow us to use it without restriction or compensation to you. Please do not send ideas you expect to keep confidential unless we have a separate written agreement.

Intellectual property and takedown requests

First Signal Games, Neon Arcana, the Neon Arcana logo, characters, factions, names, artwork, music, user interface, and related assets are protected by copyright, trademark, and other laws. If you believe content in our services infringes your rights, contact us at ops@firstsignalgames.com with enough detail for us to investigate.

Disclaimers

Neon Arcana, our websites, and related services are provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, First Signal Games will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, service interruption, or loss of virtual items or progress arising from or related to your use of Neon Arcana or our websites.

Additional terms for Apple devices

If you downloaded Neon Arcana from Apple’s App Store, the following terms also apply:

• These Terms are between you and First Signal Games only, not Apple Inc. (“Apple”). First Signal Games, not Apple, is solely responsible for Neon Arcana and its content.
• Your license to use Neon Arcana is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that Neon Arcana may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing where available.
• First Signal Games is solely responsible for any maintenance and support for Neon Arcana as described in these Terms or as required by law. Apple has no obligation to furnish any maintenance or support services for Neon Arcana.
• First Signal Games is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If Neon Arcana fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, of Neon Arcana to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Neon Arcana, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are First Signal Games’ responsibility.
• First Signal Games, not Apple, is responsible for addressing any claims by you or a third party relating to Neon Arcana or your possession or use of it, including product liability claims, claims that Neon Arcana fails to conform to an applicable legal or regulatory requirement, and claims under consumer protection, privacy, or similar laws.
• If a third party claims that Neon Arcana or your possession and use of it infringes that third party’s intellectual property rights, First Signal Games, not Apple, is solely responsible for investigating, defending, settling, and discharging that claim.
• You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Direct any questions, complaints, or claims about Neon Arcana to First Signal Games LLC, 11128 Windpoint Dr, Tampa, FL 33635, USA; telephone (407) 885-7250; email ops@firstsignalgames.com. These details also appear in the Contact section below.
• You must comply with any applicable third-party terms, such as your wireless data service agreement, when using Neon Arcana.
• Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

Governing law and venue

These Terms are governed by Florida law, without regard to conflict-of-law principles. Any dispute not subject to a platform-required process will be brought in the state or federal courts located in Hillsborough County, Florida, unless applicable law requires another forum. Your local consumer rights may also apply.

Changes to these Terms

We may update these Terms as Neon Arcana changes. The “Last updated” date above shows when this page last changed. If changes are material, we may provide additional notice in-game, by email, or through our websites.
